Gauntlet ready to tackle motor Claims reform
Gauntlet is ready to rise to the challenge after the Ministry of Justice (MoJ) announced a fast track process for road traffic personal injury claims that will see liability decisions made within 15 days as opposed to the current 90 days.
The new inititiative covers claims valued between £1,000 to £10,000 arising from accidents occurring on or after 30 April 2010 in England and Wales and completes a widely-known programme of reform which was launched by the MoJ back in 2007, which aims to settle low value road traffic personal injury claims quickly and reduce solicitor costs.
Says Gauntlet Managing Director, Roger Gaunt: “The biggest impact for Gauntlet and our valued clients is likely to be the stringent timescales imposed for insurers to decide on liability. They will have just 15 working days in which to admit or deny liability.
It is vital that you are prepared for quick (and sometimes difficult) decisions to be made. Speedy and effective communication between insurers, brokers, fleet managers, drivers, witnesses etc has never been so important.”
The major changes to the process are that claims information will be shared electronically, liability decisions should be made within 15 days as opposed to 90 under the present protocol, and that legal costs will be fixed and recoverable on a staged basis.
Adds Roger: “At Gauntlet we anticipate no changes to our business model. We believe there will still be a need for full information to be gathered and the procedures fully explained to claimants. We believe our committment to personal service will be more important than ever in what could be a turbulent period ahead.”
